1. Introduction
Welcome to HiringSecretSauce.com. These terms and conditions outline the rules and regulations for the use of our website and the purchase of our digital products.
By accessing this website and/or purchasing our products, you accept these terms and conditions in full. Do not continue to use Hiring Secret Sauce’s website or purchase our products if you do not agree with all the terms and conditions stated on this page.
2. Digital Products
All digital products available for purchase on this website are provided by Hiring Secret Sauce. These products include, but are not limited to, documents, software, books, files, and any other downloadable resources.
3. Purchase and Payment
All purchases for digital downloads are final and non-refundable. Payment must be made at the time of purchase. We accept MasterCard and VISA through our secure PayPal Gateway.
4. License and Use
Upon purchase, you are granted a non-exclusive, non-transferable license, to download and use the digital products for limited commercial use only as follows:
Professional Series Proforma’s
Commercial use only.
The Hiring Secret Sauce Proformas are professional agency hiring tools designed for, and offered to businesses, and are not recommend (or offered) to individuals.
You are provided with a license to use these proformas (in perpetuity) on the agreement that they are not redistributed, offered for sale, shared, copied, replicated, edited, altered, posted on the internet, or reverse engineered in part or in whole by you, or anyone acting on your behalf. Your professional series proforma’s are marked with a version number. Improved versions of the proforma’s may be released from time to time. Your purchase does not provide for notifications of updates, nor for free updates.
Fit for purpose.
The professional series proforma’s have been used to hire a wide variety of job roles ranging from team member through to senior manager, and across a broad range of industries. They are generic by design, to accommodate this broad range. It is therefore not possible to state conclusively that they will meet every single hiring need, job type, or the requirements of every industry sector. The professional series proforma’s are designed to enable the core hiring steps of Interviewing and Reference Checking. They do not by themselves, constitute all the steps of the hiring process. Purchasers are recommended to use the Big Five Personality Test (Psychometric Assessment) to achieve another key hiring step, and to purchase the book “Hiring’s Secret Sauce” to learn the other steps, methods, and techniques of successful hiring.
Watermarking and Territory (General).
These professional hiring proforma’s are offered to you on a single territory basis and are watermarked with identifiers obtained from the payment gateway such as your name, business name, email address, location etc.
Defined territory (Details) and license.
Use is limited to your territory and within a singular office – e.g.: your territory is defined as the geographic area in which your office conducts its business, and for which it hires its staff. The following example is provided for the USA. The same concepts of territory and business use are applicable to your own country.
- If your office is one of several across the USA and is located in California (and it is the only office in California), then your license is valid for the entire state of California, or the total area in which your office conducts its business. For example, where the California office is a regional office – i.e.: serving the entire western district of the USA.
- If your California office is the only office for your company in the USA, and it is responsible for the hiring of staff to work anywhere in the USA, then your license provides for nationwide use.
- If, however, your office is one of several within California (for example, located in San Francisco), then your license allows you to use these proformas only within and for, your business territory – i.e.: the greater San Francisco area and surrounds. Your other offices within California (e.g.: Los Angeles and San Diego) are required to purchase their own set of our proforma documents for use in their respective business territories.
Big Five Personality Test (Psychometric Assessment)
Hiring’s Secret Sauce is an authorized reseller for Talogy Inc. Our Big Five psychometric assessment may be used by any company or business entity wishing to assess their own candidates or staff. The assessment results including the downloadable pdf report, are written in English (US), and are not limited to any state, territory or country.
The contents of the report document(s) do not constitute any form of commitment or recommendation on the part of Talogy Inc or Hiring Secret Sauce / The Recruitment Partnership and speak as at the date of their preparation.
5. Delivery
Digital products will be delivered to you via email or through a download link provided immediately upon completion of your purchase. If you do not receive your digital product, please contact us at support@hiringsecretsauce.com
6. Intellectual Property Rights
All digital products are the intellectual property of Hiring Secret Sauce – as a brand name of Nexus 8 Pty Ltd trading as: The Recruitment Partnership, or Talogy Inc. You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are protected by intellectual property laws.
7. User Obligations
By purchasing our digital products, you agree not to use them for any unlawful purpose, or any purpose prohibited by these terms. You also agree not to infringe on our intellectual property rights.
8. Limitation of Liability
Hiring Secret Sauce / The Recruitment Partnership will not be liable for any direct, indirect, incidental, or consequential damages that result from the use or inability to use our digital products. This includes but is not limited to loss of data, or any other loss or damage.
9. Termination
We reserve the right to terminate or suspend your access to our digital products at any time, without notice, for conduct that we believe violates these terms or is harmful to other users of the website, us, or third parties, or for any other reason.
10. Changes to Terms
We reserve the right to change these terms and conditions at any time. Changes will be posted on this page, and your continued use of the website and purchase of products following any changes will indicate your acceptance of the new terms.
11. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Australia. You irrevocably submit to the exclusive jurisdiction of the courts in that state or location.
